Hosting terms

1. What the hosting is

We run the source code of your Discord bot, taken from a public repository you name or an uploaded ZIP file, in an isolated container on a machine we operate in Germany. The prerequisite is proof that the application is yours; it is provided by the bot token, which we check against the application ID. A listing in the Topbot.gg directory is not a requirement; if none exists, we create a draft you can build out or leave as it is. Bots whose listing is suspended or deleted are not hosted.

Hosting is an add-on to the directory, not a data centre: there is no redundancy, no availability guarantee and no compensation for downtime. We call this state "beta" and mark it on every hosting page.

2. Tiers, run time and limits

The free tier costs nothing. A bot runs on it for 48 hours from the start and is then stopped until you start it again. The Pro tier costs the monthly price per bot shown on the hosting page and in the checkout; the bot runs permanently and is restarted automatically after a crash.

Each tier has limits for memory, CPU, processes and disk space, stated on the hosting page. A container that exceeds its memory limit is restarted. The number of simultaneously running bots is limited; if no slot is free, the bot starts once one becomes available.

A bot that stays stopped for 14 days is deleted together with its files and environment variables. You receive a warning by email three days before. The listing in the directory is not affected.

3. Your code, your token, your data

The source code remains yours. We fetch it from the repository on every deploy, install the dependencies and run it; we do not modify it and do not pass it on. Environment variables including the bot token are stored encrypted; they are decrypted only to start the container and do not appear in logs.

You are responsible for the content of your code, including compliance with the Discord Developer Terms and the rights of third parties. Logs your bot produces are kept up to 10 MB per container and removed when the app is deleted.

Personal data your bot processes is processed by you as the controller. Such data lives in your container and its logs, and we access it only to provide the service. Where we process it on your behalf while operating your bot, we enter into a data processing agreement under Art. 28 GDPR with you in text form on request. An informal email to support@norecoil.de is enough.

4. What is not allowed

Not allowed are selfbots, bots to evade Discord bans, tools for raids or mass messaging, crypto mining, port scans, sending unsolicited advertising, and anything that violates the Topbot.gg terms of service or the Discord Developer Terms.

Also not allowed is sustained load that noticeably affects other hosted bots, such as permanent audio streaming or large-scale image rendering. We reserve the right to stop a container in such cases and suspend the app. You are informed of the suspension with a reason; it may also affect the listing in the directory.

5. Price, payment and cancellation

The Pro tier is billed monthly in advance via Stripe. The operator is a small business under § 19 UStG (German VAT Act); no VAT is charged. The price shown is the final price.

The subscription renews monthly and can be cancelled at any time to the end of the current billing month via the Stripe customer portal. After cancellation the app keeps running on the free tier; nothing is deleted.

If a payment fails, the bot keeps running as before for seven days. If the payment is not made within that time, the app is downgraded to the free tier. There is no shutdown or deletion because of late payment.

6. Right of withdrawal

Consumers have a statutory right of withdrawal. Hosting is a service that, at your express request, begins immediately when the subscription is concluded. By confirming in the checkout you request the immediate start and acknowledge that your right of withdrawal lapses once the service has been fully performed.

Withdrawal instructions. Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded. To exercise your right of withdrawal, you must inform us (contact details in the legal notice, email: support@norecoil.de) of your decision to withdraw from this contract by an unambiguous statement (an email is enough). To meet the withdrawal deadline, it is sufficient that you send your notification before the withdrawal period has expired.

Effects of withdrawal: If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and no later than fourteen days from the day on which we received your notification of withdrawal. We will carry out the reimbursement using the same means of payment you used for the initial transaction; in no event will you be charged any fees for this reimbursement. If you requested that the service begin during the withdrawal period, you shall pay us an amount proportionate to the service provided up to the time of withdrawal, compared with the full scope of the contracted service.

Model withdrawal form: If you want to withdraw from the contract, you may fill in this form and send it to support@norecoil.de. It is not mandatory; any unambiguous statement will do. "I hereby withdraw from the contract concluded by me for the provision of the following service: Topbot.gg Hosting Pro for the bot […], ordered on […]. Name, Discord handle, date."

7. Liability and changes

We are liable without limitation for intent and gross negligence and for injury to life, body or health. Otherwise we are liable only for breach of essential contractual obligations and limited to the foreseeable damage typical for the contract. For the free tier, liability for defects follows the rules on gifts under German law.

We may change these terms where there is a factual reason, such as a change in the law, in Discord’s terms, or in the scope of the service. We inform you of changes at least four weeks before they take effect by email and point out your right to object and its consequences separately. If you do not object within that period, the new terms apply; if you do object, the contract continues under the previous terms and either side may end it at the close of the billing month.
